Tomasz Nowicki, Partner in the Funds & State Aid practice, was a panellist at the European Tax Law Conference in Amsterdam. The discussion concerned the settlement of grants and tax reliefs in the light of EU state aid rules.
The conference brought together more than 300 tax advisers, public officials and academics from 24 countries. Tomasz’s panel focused on differences in how Member States verify state aid granted in the form of tax exemptions.
The Polish perspective
Tomasz presented experience from Polish proceedings concerning the recovery of state aid – including cases in which the authorities challenged the right to a special economic zone tax exemption several years after it had been granted.
“A business that benefits from a tax exemption must be certain that in five years nobody will question the rules on which it was granted. That certainty is still missing – and not only in Poland.”
